No-Fault Collections in New York and New Jersey
At Larkin Farrell, LLC, we fight for the medical providers who have not been paid for services rendered to those injured in motor vehicle accidents.
If you are a chiropractor, physical therapist, acupuncturist, massage therapist, neurologist, orthopedist, orthopedic surgeon, pharmacist, durable medical goods provider, surgical facility or any other healthcare worker in the state of New York or New Jersey that has yet to receive reimbursement for the care you have provided to the victims of a car accident, contact our attorneys today so we can fight to collect what you are rightfully owed.
What Is No-Fault Insurance?
No-Fault Insurance, otherwise known as “personal injury protection,” or “PIP” for short, is a system of car insurance used in both New York and New Jersey where the car insurance company provides medical coverage for treatment of injuries sustained in a motor vehicle accident, regardless of who was at fault.
Prior to the enactment of the no-fault statute, the injured person would have to wait until the personal injury claim was resolved before medical bills could be paid. The purpose of the “no-fault” system was to expedite the handling of the claims so that the medical providers could get paid, and the injured parties could get the treatment they needed, while the personal injury action was pending.
Despite the desired intent to reduce litigation and expedite the payment of claims, medical bills often go unpaid for a variety of reasons. Some of those reasons include:
- Lack of Medical Necessity
- Late Notice of Injury
- Late Notice of Claim
- Failure to Bill in Accordance with the Workers’ Compensation Fee Schedule
- Failure to Attend an Independent Medical Examination
- Failure to Attend an Examination Under Oath
- Fraud
- Lack of Causation
- Lack of Coverage
- Policy Exhaustion
- Failure to Comply with Verification Requests
The medical providers that provided these motor vehicle accident victims with the services they need to treat the injuries they sustained hire law firms like Larkin Farrell, LLC to sue the insurance carrier for those unpaid medical bills.
